Introduction

These Terms and Conditions ("T&C") constitute a legally binding agreement between Mint LLC, a New Mexico limited liability company ("Mint," "we," "us," or "our"), and you ("User," "you," or "your") governing your access to and use of the Mint website and related services (collectively, the "Site"). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these T&C. If you do not agree to these T&C, do not access or use the Site.

Eligibility

To register for and use the Site, you must be at least eighteen (18) years old. By using the Site, you represent and warrant that you are of legal age and have the legal capacity to enter into a binding agreement under applicable law. If you are under 18, you may not use the Site. We reserve the right to suspend or terminate your account if we believe you are not eligible.

Registration

You agree to provide accurate and up-to-date information during the registration process, including your email and phone number. You must promptly update any changes to this information. You consent to receive text messages and calls from us or our third-party providers for verification and security purposes.

Devices and Software

You are responsible for obtaining all necessary devices, software, and data connections to use the Site. By using the Site, you consent to receiving updates and necessary notifications to maintain functionality and security.

Permitted Use

You agree to use the Site solely for your personal, non-commercial use and in compliance with applicable laws. You may not: Resell, license, lease, distribute, or commercially exploit the Site; Reverse engineer, decompile, or attempt to access the source code; Use the Site for any unlawful purpose or post unlawful content; Harass, impersonate, or intimidate others; Distribute malware, viruses, or any harmful code.

You are solely responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.

Privacy

Your use of the Site is subject to our Privacy Policy at https://getmint.lol/info/legal/privacy-policy. By using the Site, you consent to the collection and transfer of your data to the United States. If you do not agree, discontinue use immediately.

We do not knowingly collect data from children under 13 without verified parental consent. If we become aware of such collection, we will promptly delete the information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID BY YOU TO MINT IN THE LAST TWELVE (12) MONTHS, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Mint and its affiliates, employees, officers, and agents from any claims or liabilities arising from your use of the Site or breach of these T&C.

Dispute Resolution

Disclaimer of Warranty

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." MINT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.

Amendments

We may update these T&C at any time. Changes will be communicated via email or through the Site where possible. Continued use of the Site constitutes acceptance of the updated T&C.

Severability and Waiver

If any provision is unenforceable, the remaining provisions shall remain in effect. A failure by Mint to enforce any right does not waive that right.

Governing Law

These T&C are governed by the laws of the State of New Mexico. Any disputes shall be resolved in the appropriate courts in New Mexico.
